What does an optimal solution to an intellectual property dispute look like?
In IP disputes, the best outcome may go beyond determining who is legally right. It may mean finding a way for both parties to move forward—through licensing arrangements, joint ventures, or other tailored settlement structures that preserve commercial value and business relationships. This is where mediation can offer particular advantages. IP assets are intangible, disputes frequently cross borders, and technology and markets evolve rapidly—all factors that can call for solutions beyond the traditional outcomes of litigation.
At the International Bar Association Annual Conference in Copenhagen, Camille Aubin (ROBIC; Vice Chair, IBA Trademark Law Subcommittee) and Natascha Tunkel (KNOETZL; Senior Vice Chair, IBA Mediation Committee) will co-chair the session “Mediation encourages innovation.” They will be joined by two outstanding experts in the field, Karin Kuhl (EUIPO – European Union Intellectual Property Office Mediation Center) and Ronald Dimock (Dimock IP), bringing extensive experience in IP and alternative dispute resolution to the discussion.
